Hong Kong caps moneylender debt-service ratios for low-income borrowers from August 2026

Hong Kong's Financial Services and the Treasury Bureau (FSTB) published its consultation conclusions on enhancing the regulation of licensed money lenders on 13 March 2026, and the Companies Registry has implemented the first phase through licensing conditions (sources: FSTB; Companies Registry).
From 1 August 2026, a new licensing condition caps the debt servicing ratio (DSR) of borrowers with a monthly income of HKD 12,000 or less a month: 35% for income of HKD 6,000 or less a month and 40% for HKD 6,001–12,000 a month. For borrowers on fixed-term employment contracts, the repayment period of an unsecured personal loan should not exceed the remaining contract term. Under a revised licensing condition, lenders may no longer request or obtain referee information, and must stop using referee details obtained before 31 July 2026 (source: Companies Registry). 1 The statutory interest rate cap stays at 48% a year (source: FSTB). 2
The second phase starts on 1 June 2027. All lenders with unsecured personal loan business, estimated at about 800, must submit borrower credit data to the Credit Data Smart (CDS) platform, with a six-month transition. Lenders with unsecured personal loans above HKD 50 m, or lending to borrowers in the low-income band, must also join and use CDS, estimated at about 340 (source: FSTB). 3
Market size per FSTB: 2,110 licensed money lenders at end-2024 (down about 7% from end-2023); unsecured personal loans of around HKD 47.2 bn with an average default rate of around 9.3%; the top ten lenders held around 64% of that amount. 4 Borrowers earning HKD 10,000 or less a month made 29% of loan transactions and defaulted at 9.4%, against an overall default rate of 7.0%; foreign domestic helpers were the largest occupation group at 26% of loans, with a default rate of 9.9% (source: FSTB). 5 Secretary for Financial Services and the Treasury Christopher Hui said the same requirement applies to everyone below the income threshold, not only domestic helpers (source: news.gov.hk).
Analysis
Hong Kong and Singapore are tightening licensed-moneylender rules at different points in the loan cycle. Singapore's September 2026 rule acts after signing: a cooling-off period of three business days with retained fees capped at SGD 50 for small loans. Hong Kong acts before signing, with an income-banded DSR limit, and adds shared credit data from 2027. For lenders, a Hong Kong-style cap removes loan volume up front, while a Singapore-style rule removes part of fee income after approval.
The gap in credit quality explains the focus. The money-lender default rate of around 9.3% sits far above the banking system's classified loan ratio of 1.82% (end-June 2026). The two measures use different definitions, so the comparison shows scale rather than a like-for-like gap. Market concentration (around 64% held by ten lenders) suggests that lenders above the CDS threshold of HKD 50 m hold most balances, while many small lenders only report data.
Implications
Counterpoints and uncertainties
Default rates in the FSTB conclusions date from 2023–2024 and predate the new rules, so their effect on losses is not yet visible. Income-banded caps can push rejected borrowers toward unlicensed lenders or toward several small loans below the reporting scope until CDS reporting is complete. The data-sharing phase depends on CDS readiness and participation; the timetable could still move.
