Key points

Implications for lenders

A lender pricing used-car or motorcycle hire purchase in Thailand now faces state-bank competitors bound by the same 15% and 23% ceilings, so risk-based approval and down-payment policy may matter more than rate. Collections terms are tighter at state banks, with default interest limited to 5% a year and no penalty fees on individuals. Early-payoff discounts of at least 60% to 100% of unmatured interest can reduce income on contracts that prepay.

Implications

ExecutivesState banks that offer vehicle hire purchase must reprice any personal-use contracts above the caps and adopt the early-payoff discount and fee limits from 1 November.
InvestorsWith state and private vehicle lenders under the same rate ceilings, margins on used-car and motorcycle loans depend more on credit losses and funding costs than on pricing.
OperatorsLoan systems at SFIs need effective-rate calculation, the tiered early-payoff discount, oldest-first payment allocation and a debt schedule issued at signing.

Facts

The rule: the Bank of Thailand (BOT) issued Notification No. 51/2569 on hire purchase and leasing of cars and motorcycles by specialised financial institutions (SFIs), the state-owned banks, on 7 October 2026, together with Notification No. 52/2569 amending the rules on default interest and payment allocation. Both were published in the Royal Gazette on 9 October and take effect on 1 November 2026. The rules apply to all SFIs under the Financial Institutions Business Act; the Islamic Bank of Thailand applies them consistently with Islamic principles.

Rate caps: for individuals buying a vehicle for personal use, the maximum effective annual rate is 10% 1 for new cars, 15% 2 for used cars and 23% 3 for motorcycles. The worked example attached to the notification shows a flat rate of 8% a year (flat) 4 on a one-year car contract equal to 14.45% a year (effective) 5.

Arrears and early payoff: default interest may not exceed 5% a year 6, charged only on overdue instalments, and payments clear the oldest overdue amounts first, in the order of fees, interest and principal. Penalty fees other than default interest may not be charged to individual hire-purchase customers. A customer who pays off early receives a discount on unmatured interest of at least 60% 7 after up to one third of instalments, at least 70% 8 after up to two thirds, and 100% 9 after that.

Fees and disclosure: a contract change requested by an individual customer may cost at most THB 2,500 10; one-time service fees may not be set as a percentage of the vehicle price; and customers must receive a debt schedule when they sign. Default interest for business-use and corporate customers and for leasing follows Notification No. 52/2569.

Analysis

Comparison within Thailand: the SFI ceilings of 10%, 15% and 23% match the caps the Consumer Protection Board's Contract Committee set for car and motorcycle hire-purchase businesses from 10 January 2023 (10% 11, 15% 12 and 23% 13). State banks now price under the same ceilings as other vehicle lenders, so competition in this segment turns on approval criteria, down payments and service rather than on rate headroom.

Cross-country comparison: Thailand sets a different ceiling for each vehicle type, while Cambodia applies one cap of 18% 14 a year to loans of any maturity by deposit-taking MFIs, MFIs and rural credit operators. The Thai motorcycle ceiling sits above the Cambodian cap and the new-car ceiling below it. In Thailand, the draft rules for buy-now-pay-later credit propose 15% a year (effective rate) 15, the same level as the used-car ceiling.

What the example shows: a flat rate of 8% a year (flat) equals 14.45% a year (effective) in effective terms on a one-year contract, so a flat-rate quote well below the headline cap can already be close to it once converted.

Counterpoints and uncertainties

The notification gives no data on the SFIs' current vehicle hire-purchase rates, portfolio size or share of the market, so how many contracts need repricing cannot be read from the source. The notification does not compare its ceilings with the Contract Committee caps, and the two sets of rules are applied by different authorities, so differences in how fees and the effective rate are treated could matter. Rate ceilings on higher-risk segments such as used cars and motorcycles can lead lenders to tighten approvals or raise down payments, which could limit access for some borrowers; how the SFIs adjust will show in their lending data.
